! When owning any design's by me you automatically abide and accept my rules and Terms Of Service as this is linked everywhere. It is not my fault if you actually read them or not when owning my designs or artwork !
This terms of service has been around and existed since early 2015 with major edits done to it in 2021 for this current one in use.
My blacklist is at the VERY bottom of this so no excuse that you didn’t see it

Adoptable / Custom designs
The following rules of any design's I have made. I link this everywhere so no matter what you automatically abide by my terms when purchasing a design made by me wither you read them or not.
When Blacklisted
I have specific rules stating yes's and no's when dealing with those on my blacklist. They should cover any if not all questions regarding my blacklist and what they can and cannot do!

Adoptable / Custom designs
◈ Please understand before you purchase any designs by me or own any designs by me I do NOT give refunds out at all unless it’s like a custom I can’t finish personally which I will be the one happily reaching out telling you I’m giving you a refund and why!
- This means if you’re to get a design revoked you will not be refunded for the oc. Only way to get a design revoked though is if you break major rules of my tos so at that point it is your own fault for getting them revoked.◈ You must at all times give me credit to the design when posting them on other sites. When crediting on certain sites please use the following;

DrownedCryptid @ Furaffinity (Inactive)◈ None of my designs are allowed to be sold on Chatlands.com or sold on ANYTHING associated or remotely similar with that site and YES this includes knock off chatlands.com made places that chat users migrate too! It is strictly prohibited now as of 3/7/2024 and can result in you being blacklisted from owning future designs made by me.
- This includes Safe Haven (Heaven?) and starts 11/28/2024 for them.◈ My designs must at all times be kept and made into toyhouse so that I may keep track of them at all times. If you are caught deleting them from toyhouse and still using the design you will get one verbal warning to remake the toyhouse and upload the design to it with proper credit to me before the design is revoked and you are blacklisted if it is not done within a week of the verbal warning. If it is hidden from public eye please at least allow me to see the design so that I may keep track MY designs and nothing else!
- No if, and’s or but's. I think this rule is extremely easy and fair to follow and if you do not have a toyhouse but want my design(s) please just ASK me!! I have plenty of codes to give out so you can get one for free!◈ Those who are found out to be an active groomer, pedophile, necrophilia, zoophilia and anything else that is ILLEGAL who also own my designs can and WILL have any designs by me automatically revoked if I feel like they are going to be a reoccurring predator in any of those categories. This rule starts 6/1/2024.
- This includes friends, associates, followers, supporters and/or customers of those types of people as you are simply an enabler of them and their actions and nothing you say will defend the matter.◈ You must have my written permission to resell any of my designs! You may go ahead and trade OR gift them away without informing me but when reselling you HAVE to get my written permission and show me the amount you want to sell them for; free artwork, free bases and gifts are NOT to be added to the designs value.
- This does not include special designs of mine that may come with a very specific and special ToS. Keep in mind these types of characters usually are due to being EXTRA personal and dear to me so it isn't just a random design.◈ You must have my written permission to breed any of my design’s. If you do not ask for permission the design will be reported as theft and removed and you will be warned. It happens again it WILL result in a blacklist.◈ You can mod my design to your liking if it is slightly changing the hue of said design to darken or lighten it a tad or changing the hair and eyes but NOTHING too drastic like an orange design turned pink or green. That is NOT allowed at all!◈ It is highly recommended you come to me about sales if you feel weary about your pricing for a design I created that you no longer want after getting the permission to rehome said design! I do not mind helping you out!◈ If you were to receive a design made by me in any sort of trade you may add an estimated value for the design( for example you traded a $50 character you may set the estimated value to $50) but please do not resell them for any cash value unless you have added artwork you paid for or made yourself (matching your own commission prices to it). You may not include gifts or trades from other’s to the design’s value unless you show me solid proof that the artist gave you permission to include it into the value of the design.
- Without my written permission you may not resell a design of mine you received in a trade unless you have my written permission to do so. If you have an emergency that pops up please ask me to resell it instead of just doing it.◈ Vouchers for designs by me are alright as long as it's reasonable. This means you may not over-price the design’s value to get a super expensive design when initially you only traded something that only added up to $50 for them.◈ Your Terms Of Service / rules do not apply to my design ever. You may at most ask the new owner politely to be pinged for when they ever wish to resell or trade the design you are parting with- they are NOT required to strictly only sell or trade back with you. This includes "trade locks" under this category and I should not have to explain why as the reasoning is at the beginning of this rule.◈ If you oversell my design for more than you paid, you will be blacklisted, as this is not okay. You price ocs with the value of what you've paid, what you've worked on, and that's it. Do not profit off someone's gift or trades to you unless the artist STRICTLY gives you permission to add gifts or trades to the value - if it comes down to it I will be asking for you to show proof of the artist giving said permission if people report you over pricing and you claim they allowed you to add the gifts or trades to the cash value.
When Blacklisted
◈ Anyone on this list has 0 permission to use any design’s OR artwork from me UNLESS THEY HAD IT BEFORE THEY WERE PUT ON MY BLACKLIST.
- This includes not allowed to do co-owns either because that is still them having access to and owning MY design. Not okay and not allowed.◈ From the date they were set on my blacklist and forward they are unable to use ANY designs or artwork from me whether it’s new or old. This does NOT include if they got the design OR work prior to being blacklisted!
- This does NOT include if they are caught drawing/supporting/doing illegal shit even if it doesn't include my design I will fully revoke ANY and ALL designs of mine you own by that point no matter what. No one is ever allowed my designs when they have ties to anything of that matter. This includes rape, incest, hate art, zoo, necrophilia and so forth of similar matters.◈ If they own a design by me before the blacklist date when you got added to it and you get rid of them after that point of no longer owning them they are unable to get them back. You were only allowed to keep the design if you owned them prior to being blacklisted but once you give them up you can’t have them back.◈ If you sell a design that had artwork by me before the date when you got added to my blacklist and you get the design back you aren’t allowed to use the artwork again- you were only allowed to it being you already had the artwork prior to being blacklisted. Once you give a design that has my artwork and try for them back you can’t use the art anymore.◈ I got permission from the creator of the design formerly known as Rim/Rover to put a tos onto said design which states absolutely NO ONE on my blacklist may own them if I ever decide to sell! Screenshots will be given to the new owner if they’re ever rehomed!◈ The following users/accounts in the "My Blacklist" section are ones one my blacklist, dates when put onto it, lists of past usernames that I know of and some have reasonings public as to why they’re blacklist as I feel some should be public for warnings to others to be wary of those individuals is all.

Reasoning: Active groomer who preys on mentally unwell individuals, hardcore manipulator, huge victim complex, heavy abuser, and in the past drawing feral NSFW art and even despite claiming he doesn't draw it anymore and "got away from that bad crowd" turned out he lied because he is still very much friends with zoos + feral artist. I do NOT trust anyone who is still friends with him after he got exposed of his disgustingly cruel behavior with many long-lasting victims that finally got away.

Reasoning: Tried to scam me out by claiming they were purchasing a design and ‘sent payments that are just pending’ that I never received at all and then proceeded to rip off the design to a T with even the same exact name. Does this to other people as well with their oc’s so not a first offense. They do this to keep the copy for themselves or sell off to make profit from the theft.
